KOLKATA: CBI doesn't need consent from state govt to conduct a
preliminary probe
against officials of central govt and PSUs with their office in the state,
Calcutta high court
said on Monday. Passing an order for a preliminary probe against
SBI officials
, Justice Tirthankar Ghosh cited earlier orders of HC and Supreme Court in response to a CBI report that a probe against the public servant was awaiting sanction from the state.
CBI DIG, in a communication to SBI regional manager on Aug 7, 2024, held that an application for granting sanction to proceed against the public servant was made to additional chief secretary and a response was still awaited.
"This court earlier laid down the law. SC also passed an order. There is no need for taking sanctions from the state. If the probe agency seeks sanction from the state, the application will go to the dustbin," Justice Ghosh said.
